1. Acceptance of these terms
By using our website, placing an order, requesting a custom design or accepting a quotation, you agree to these terms, together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy. Nothing in these terms limits any rights that cannot lawfully be excluded under South African law.
2. Products, descriptions and availability
We aim to describe and display products accurately. Colors and scale may vary slightly between screens, mock-ups, garment batches and finished prints. Product availability, garment brands, colours and sizes may change. If an item becomes unavailable after ordering, we will contact you to agree on a suitable alternative or refund the affected item.
3. Prices, payment and VAT
Prices are displayed in South African rand (ZAR). JCSmash is not currently registered as a VAT vendor and does not charge VAT as a registered VAT vendor. Delivery charges, where applicable, are shown separately at checkout or in a quotation. An order is not confirmed until payment is successfully authorised or other agreed payment arrangements have been accepted by us.
4. Orders and acceptance
Your checkout submission is an offer to purchase. We may refuse or cancel an order before production for genuine reasons such as pricing or stock errors, suspected fraud, unlawful content, inability to fulfil, or payment failure. If we cancel a paid order before fulfilment, we will refund the amount due.
5. Custom and personalized orders
For custom printing, you are responsible for checking spelling, names, dates, sizes, colours, placement and other details before approving the artwork or production instruction. Once a made-to-specification or clearly personalised item has entered production, change-of-mind cancellation or return rights may be limited to the extent permitted by law. This does not remove your statutory rights where goods are defective, unsafe, incorrectly supplied or otherwise fail to meet applicable legal standards.
6. Customer-supplied artwork and intellectual property
When you provide artwork, logos, photographs, text, trademarks or other content, you confirm that you own it or have sufficient permission to use and reproduce it for the requested order. You authorise JCSmash and our production partners to use that content only as reasonably necessary to quote, prepare, print and fulfil the order. We may refuse content that appears unlawful, infringing, hateful, defamatory or otherwise inappropriate. You remain responsible for obtaining required permissions for customer-supplied content.
7. Production and delivery
Production and delivery timeframes are estimates, not guarantees, unless we expressly agree otherwise in writing. Launch shipping is limited to South Africa. Current delivery options and charges shown at checkout apply to the order. Please ensure that your delivery address and contact details are correct.
8. Cooling-off, cancellations and returns
Eligible electronic transactions may carry cooling-off rights under the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”). Where the statutory cooling-off right applies to goods, a consumer may cancel within the applicable statutory period after receiving the goods, subject to the Act, and may be responsible for the direct cost of returning them. ECTA contains exclusions, including certain goods made to the consumer’s specifications or clearly personalised. Our Returns & Refunds Policy explains how to contact us and does not limit statutory rights.
9. Defective, unsafe or incorrectly supplied goods
Our goods are supplied subject to the Consumer Protection Act, 68 of 2008 (“CPA”). Where the CPA applies, consumers have statutory rights relating to goods that are unsafe, defective, not of good quality, not reasonably durable or not fit for their intended purpose. We will not use these terms to exclude rights or remedies that the CPA does not permit us to exclude.
10. Website content
Unless otherwise stated, our website design, JCSmash branding, original graphics, product photographs, copy and other original content are owned by or licensed to JCSmash. You may not copy, reproduce or commercially exploit them without permission, except where permitted by law.
11. Responsible website use
You may not misuse the website, attempt unauthorised access, introduce malicious code, interfere with the store, submit fraudulent orders or use our services for unlawful activity.
12. Liability
To the maximum extent permitted by law, JCSmash is not liable for indirect or consequential losses arising from circumstances outside our reasonable control. Nothing in these terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by law.
13. Privacy
We process personal information in accordance with our Privacy Policy and applicable South African data-protection law, including the Protection of Personal Information Act, 4 of 2013 (“POPIA”).
14. Changes to these terms
We may update these terms when our services, legal requirements or business practices change. The version published on the website at the time of your transaction will generally apply to that transaction, subject to applicable law.
15. Governing law and complaints
These terms are governed by the laws of the Republic of South Africa. If you have a complaint, please contact us first at JCSmash4219@gmail.com or WhatsApp 065 083 3401 so that we can try to resolve it promptly. You remain entitled to approach any regulator, ombud, tribunal or court with jurisdiction where permitted by law.
